Practice Strengths

Insolvency

Bartier Perry has a strong insolvency practice (both personal and corporate) which sees us acting for insolvency practitioners who require assistance in all forms of external administration.

We provide advice and prepare documentation for formal financial restructuring through voluntary administration or Part X of the Bankruptcy Act. We can advise in relation to Deeds of Company Arrangement, Personal Insolvency Agreements, and can assist with the procedures involved in the various financial reconstruction regimes. When matters proceed to receivership, liquidation or bankruptcy, we act for receivers, bankruptcy trustees and liquidators in relation to all other aspects of insolvent administrations, including voidable transactions, adjudicating on creditors’ proofs of debt, retention of title claims, and realising assets for the benefit of creditors.

Conversely, we often represent creditors whose debtors have been placed in the various forms of insolvency administration. The needs of these clients range from the defence of unfair preference claims by liquidators and trustees to pursuit of directors and officers of corporations for insolvent trading and the protection of assets over which security is held.

Finance Recovery

We have considerable experience in secured and unsecured finance and debt recovery work for our clients both in the government and corporate sector. As required, our clients include major finance companies, merchant banks, statutory authorities, building companies and technology/office equipment companies.

We are experienced in all aspects of loss and asset recovery and securities enforcement in the Local Court, District Court, Supreme Court and Federal Court as well as by utilising winding up and bankruptcy procedures.

As we recognise from our experience that efficiency is the key to effective asset recovery, we have developed a system of file management for this work which provides our clients with monthly or weekly reports updating the status of all claims. Additionally, we have assisted our clients to develop internal systems to achieve recoveries without needing to instruct lawyers.
