Bartier Perry’s corporate and commercial lawyers are a close knit team who take time to understand the commercial objectives of their clients and tailor legal solutions to suit their client’s specific requirements.

We offer a high level of senior lawyer accessibility and a commercially grounded alternative to the big law firms. 

For larger enterprises we are able to form part of the matrix of legal service providers to which they turn for advice on a project or to handle a particular category of work.  For smaller enterprises we are often the sole source of legal support.

We keep a close eye on providing value for money.  We do this through competitive hourly rates, working quickly and efficiently and by not putting more lawyers on a job than are required.

Our clients come from a number of differing industries and include public companies, private companies and public sector organisations. We are experienced in advising on issues arising in family owned businesses.

Compliance

As lawyers we are familiar with the need for clients to comply with obligations imposed on them by the law. 

These days obligations are also imposed by other interested parties.  These can include a regulatory body, a shareholder, a lender, a business partner, a board of directors, a customer.

We are often called on to assist our clients to develop and implement compliance programs.  This may involve assisting with a risk analysis to identify areas in clients' business activities on which they should concentrate. 

As part of our service we are able to conduct training programs in areas including trade practices, privacy, credit control, contract management, insurance, intellectual property and OH&S.

We focus on prevention.  It is better than the cure.

We deal with the needs of the business in an uncomplicated way to make it easier for staff at all levels to understand and meet their obligations.


Intellectual Property

Bartier Perry’s Corporate and Commercial team has particular expertise in intellectual property. The protection, management, commercialisation and enforcement of intellectual property rights are a key part of our practice. 

We act for, and actively assist, many organisations whose business is founded on, or is dependent on, intellectual property rights.  We pride ourselves on being able to offer an integrated approach to IP issues providing strategic and legal advice across a full spectrum of IP related issues. 

Our clients include universities, education providers, area health services, research organisations, IT service providers, software developers, engineers, designers, manufacturers and marketers together with investors in such businesses.
We keep abreast of industry issues, and contribute to the debate on those issues through our membership of organisations like the Licensing Executives Society of Australia and New Zealand and the Australian Information Industry Association.

IP Protection – Generally  We assist our clients with the protection of their intellectual property through the development of policies, procedures and systems designed to ensure our client’s ability to harness the creative output of its workforce and to reduce the risk of loss. 

IP Protection – Trade Marks  We advise our clients about branding and how to achieve better value from the effective use of trade marks. We also assist our clients with the registration and maintenance of their trade mark portfolios, in Australia and internationally. We advise our clients about the likely success or potential problems with the proposed use and applications to register those trade marks.

IP Commercialisation  We have significant experience of being involved in transactions relating to the collaborative development and commercialisation of intellectual property including licensing agreements, acquisition and disposal of IP together with franchising and distribution and marketing arrangements.


Start Up and Early Stage Enterprises

Through experience and active involvement with many early stage and emerging companies Bartier Perry knows what it takes to start and grow a business and what is required of lawyers at this stage of the business life cycle.

We achieve this outcome by ensuring that senior practitioners with a broad range of skills are involved in providing advice – practitioners who are able to readily understand the commercial issues.
