A Year In Review: Good Faith Bargaining
It has now been a year since the good faith bargaining provisions in the Federal Fair Work Act 2009 commenced operation. For the most part, employers, employees and unions have embraced the obligation of good faith bargaining and successfully negotiated enterprise agreements at the workplace. In this bulletin we examine the development of the law concerning good faith bargaining.

Impairment - deduction for prior injuries
An assessment of impairment for lump sum compensation or work injury damages must take into account any relevant deduction for previous injury or pre-existing condition or abnormality. In this bulletin we examine recent judicial interpretation of section 323 and how a previous injury should be taken into account when determining impairment following a subsequent injury.

Be prepared! Mandatory disclosure for the energy efficiency of commercial office buildings
To enable potential purchasers or lessees to consider energy efficiency as part of their decision making processes, the Building Energy Efficiency Bill 2010 (Cth) (Bill), places obligations on vendors and landlords to disclose the energy efficiency of large commercial office buildings on sale, lease or sublease. The Bill, once passed, will have retrospective application from 1 July 2010 but the disclosure obligations will start from 1 October 2010 to allow parties affected by the disclosure obligations time to prepare. In this bulletin we outline the details of this Bill.

Superannuation Instalment Warrants - new bill introduced to change the rules
As many practitioners are aware, whilst the introduction of section 67(4A) in the Superannuation Industry (Supervision) Act 1993 introduced new investment opportunities for trustees of superannuation funds, there has also been some uncertainty and concern as to the operation of the rules and the permissible boundaries. Treasury has now sought to further clarify the area by the introduction of the Superannuation Industry (Supervision) Bill 2010. This bulletin will look at the key aspects of the bill.
