New obligations have been imposed on principals under the Building & Construction Industry Security of Payment Act. There will be adverse consequences for local councils if they fail to comply with the obligations, or mistakenly comply when they are not required to do so.

Australia's new personal property law – no more false starts
It now looks certain that PPSA will commence on 30 January, 2012. In the attached article Oliver Shtein provides an overview of the impacts of PPSA for hire businesses as well as for those businesses which sell on retention of title or on consignment terms. Have you updated your warranties against defects?

Home Building Amendment Act 2011 – Alert for Builders, Owners and Developers
The Home Building Amendment Bill 2011, passed in October, includes a number of changes which affect home warranty insurance and claims, enforcement of statutory warranties and proportionate liability. Some of these reforms are already in effect, commencing upon assent, while the remainder is expected to commence in February 2012.

PPSA – The Final Countdown?
The Government has announced that Australia's new personal property securities law will 'go live' on 30 January, 2012. With just over two months left, now is the time for businesses to check they understand the impact of the new system. An understanding of the system will be critical, not just to banks and financiers but also to hire companies and to manufacturers and distributors who sell on retention of title or consignment.
