Stephen is a Senior Associate within Bartier Perry’s Workers Compensation team with over eleven years’ experience in Insurance Claims.

Specialising in premium reduction for companies and pre-litigation strategy for statutory agencies, he advises on the day-to-day conduct of claims with a focus on early and timely resolutions.  Stephen has initiated and managed a wide range of claims commenced in various jurisdictions.

Stephen provides strategic advice on complex and sensitive claims for workers compensation and work injury damages.  He has had significant success in claims where injury is alleged to have been caused by unfair and unreasonable employer action, misbehavior, bullying and harassment and interpersonal conflict within the working environment.

Career highlights

  • Leading a targeted work injury damages project for a key client to assist in driving down their common law settlement averages and litigation costs

  • Successfully pursuing and managing recoveries in accordance with section 151Z of the Workers Compensation Act 1987 with an aim on achieving cost effective recoveries. Facilitating early informal settlement conferences to achieve this objective and have recovered in excess of $10 million dollars to date

  • Successfully defending a workers compensation claim for psychological injury due to workplace bullying harassment. Evidence obtained to establish that the injury was the result of reasonable management action under section 11A(1) of the Workers Compensation Act

 

Specific areas of focus

Litigation and dispute resolution: Stephen routinely represents clients at teleconferences, mediations, conciliation and arbitration hearings in respect of workers compensation claims in the Workers Compensation Commission. He advises on appeals from decisions of arbitrators and approved medical specialists. He defends work injury damages claims from initial notification stage to actions commenced in the District Court of NSW and Supreme Court of NSW.

Management of complex claims: Stephen provides concise, tailored advice regarding the management and compilation of evidence required, particularly involving psychological injury claims of alleged bullying and harassment in the workplace. Stephen has a specific focus on identifying critical evidence required to establish the statutory defence under section 11A(1) of the Workers Compensation Act 1987.

Legal knowledge and skills: Stephen regularly speaks on aspects of insurance law and related matters. Particularly, the publication and distribution of case law updates involving developments in the Workers Compensation Commission and other courts in the State of New South Wales.
