Protecting your business: strategies to protect from unfair competition

Businesses invest significantly in their people, client relationships and operations. Post-employment restraints are an important tool for protecting that investment by preventing unfair competition from departing employees and safeguarding confidential information.

The Federal Government's proposed Competition and Fair Work Legislation Amendment (Banning Unfair Non-Competes) Bill 2026 represents one of the most significant workplace reforms in recent years. The changes may limit employers' ability to protect legitimate business interests, increase the risk of competitors poaching key employees, and reduce incentives to invest in employee development and training.

As traditional restraint protections become more limited, businesses will need to consider alternative strategies to protect confidential information, client relationships and workforce stability, including reliance on statutory duties and other legal protections.
