Building & Construction Industry Reform

On 11 June 2020, the Design and Building Practitioners Act came into force. It’s a real game changer, and will impact any person involved in the building and construction industry in NSW.

The new Act is about restoring public confidence in the NSW building industry by regulating the activities of those who design and construct new buildings.

Among other things, the Act creates a new duty of care which is additional to any duties, statutory warranties and other obligations imposed under other legislation, including the Home Building Act. The duty of care provisions came into force last June when the act commenced.

The start of other provisions of the Act, mostly relating to the registration of building practitioners and their reporting requirements are set to start shortly on 1 July 2021. 

Also starting on that date are the much awaited Design and Building Practitioners Regulations which set out the process practitioners now need to follow to ensure their work is compliant.
