Decisions with precision: the art of defensible decision making

In a world where adverse action claims are exploding and disgruntled employees seek to attribute blame to others rather than be accountable for their own actions, the importance of robust decision-making processes and strategies has never been more important to defeat these claims.
Defensible employment decisions require careful consideration and active planning. Ensuring that the right people are involved and ensuring that those who are involved have access to the relevant (and lawful) information is critical when it comes to defending that decision.
In this presentation, we will examine employment decision making processes and how those processes should be informed by, and conscious of, the adverse action jurisdiction of the Fair Work Act 2009 (Cth), anti-discrimination legislation and recent changes to the victimisation provisions in the Industrial Relations Act 1996 (NSW).
We will look at the practical realties and give some tips to assist in arriving at a defensible decision.
